Question:

Can I press Charges???

I have a strong feeling that one of my neighbor is sabotaging my car...Putting nails in the tire, and vandalizing it.If I do not have any proof. Can I press charges?? I live in South Carolina.

Answer:

You can file a police report and list him as a suspect. and you CAN press charges. But, you have an issue here: You need a solid witness, and you needto prove your alligations. Also, the police may not take the case. After all, its not what you know, it is what you can prove. the chapter on Ciminal Mischief in your state would define the punishment depending on the amount. check it out.
you have to have proof that it's your neighbor without some sort of proof the police aren't even gonna check it out since it'll be your word against the neighbor and it's just gonna cause more bad blood between y'all...set up a survellance around your car and watch to see if someone does mess with your car then take it to the police
No, you will have to witness the destruction of your property first hand. You can call and report vandalism to your car. It would be good to have it already on record. Keep an eye out for them though. Video tape them. Don't lay hands on them, I know personally that is when the police actually do something, they arrest you instead.
No. In order to press charges, police would have to have the perpetrator in custody and there be significant evidence with no doubt that this was the guy that was doing it. You can report it and the police might come fill out a report and possibly ask your neighbor some questions. But without proof, there is no solution. Maybe having the cops nose around about it will be enough to deter any future problems though.
Report it and if you really believe it's your neighbor and believe they have a motivation for doing so, tell the police. They will interview the kid and that should be enough to stop him. IMPORTANT..if you find out later that it WAS NOT your neighbor...head over immediately with a new Ipod and a sincere apology.
