can i sue the resturant for having a defective high chair?

my 8 month old fell out of a high chair at a restaurant and cut her lip it was due to the seat belt braking while she was still in it. my shirt was very bloody and all they offer was club soda and ice.i just thought they could have done more! should i sue?

thats stupid. its not the restaurants fault. and im sorry, but all a restaurant will have to offer as far as medical help for a 8 month old is club soda and ice. so they did all they could.
What more would you want them to do? None of them, I'm sure, are qualified to offer medical assistance. Cuts to the lip, unless severe, typically heal on their own (some ice to reduce swelling seems right). They could have offered to pay for the cleaning cost of your shirt, sure, but you seem to want more Your child doesn't seem severely injured; you would have taken her to the emergency room she had, right? Sure you can sue them, but that doesn't mean you're going to get any money from them. Just thank your lucky stars your child is okay and maybe inspect the high chairs yourself the next time you take your kid out to eat.
Of course you can sue, but it's the winning the case you might have a problem with. The restaurant won't be at fault because they did not make the highchair. They also probably didn't comp you for anything because, while your day was ruined, they believe nothing was wrong with the food or service. I hope she is ok and feels better.

Was it presented to you or did you select it? Their lawyer could say you picked the defective chair (if you did) so it is no fault of their own although your lawyer could indicate that the chair should have been out of service.
