Question:

Can she really press charges?

I'm a 18 year old girl, who works at a dept store. I got into a heated argument with this woman who is probably in her late 40s. The argument escalated and SHE punched me first. That's when we started fighting. I beat her up bad, and when we were stopped she said she would be pressing charges. We are both white women. Can she really press charges even though she through the first punch?

Answer:

Yes, but so can you. Get an attorney.
yeah she can you should have stopped before you beat her up that bad
Yes...
Yes cuz u wer should have asked for security and not fight bak but u could also I believe
Yes, she can press both civil and criminal charges for Assault and Battery. It doesn't matter who threw the first punch although you could claim that as a mitigating circumstance. Self-defence is a defence against an AB charge, but if you beat her up bad that means at some point you were no longer defending yourself and became the aggressor. Better hope she goes away. Of course you can file a counter claim to muddy the water and hope the judge throws both charges out.
