Question:

How do I get power of attorney, my brother lived in California he died in Texas, I need to settle his estate?

I live in Texas I need to attain power of attorney , my brother who lived in California came to visit and passed away suddenly from a heart attack. He had no will I know of. I need to settle his estate, he was not indebt to anyone. I need to take care of his bank accounts. He was divorced and had no other dependents. What is the legal procedure to attain power of attorney.

Answer:

talk with an attorney
That is a tough one. Really the only way to get power of attorney is to have your brother sign it over. Obviously that is not an option for you. Unless you have some documents stating that you are the one that will settle affiars for your brother you may be SOL. If he was married his wife will most likely take anything coming. sorry bro.
i would talk to someone who knows about power of attorney and ask him/her if there is anything i could do. explain the situtation to the attorney and see what happens good luck nad
Go to a lawyer
an impression of lawyer must be signed in case you're nevertheless mentally sensible. you may bypass to courtroom to be appointed her dad or mum. This is composed of seeing a choose, i'm no longer effective which state yu would attempt this in, yet i imagine you would attempt this in the state she lives (California). employ a felony specialist.
