Answer:

Get both, kennel first. Kennel for when he's small and needs to be closely confined at night, exercise pen for when he's a bit older and more reliable with the housetraining but still young enough to chew everything in sight if not watched.
The law bites. Just more ammunition for us conservatives to limit government. You know that it's just a matter of time, with the prevalence of obesity, diabetes, heart disease, and such, that the government (in its infinite and collective wisdom) will outlaw unhealthy foods and start mandating exercise. Mark my words. And if you think otherwise, you need to take a long, hard look at historical evidence. (check your email) Government bashing is a good thing. Keeps those knowitalls on the defensive.
I understand why the government is doing this, but I can also see how it will hurt families already struggling in this economy. It has not effected me yet as I have not had to buy anything used (still wearing baby shower gifts) but it may in the future. The last thing we need is to lose organizations such as Goodwill and Once Upon A Child because they are unable to sell their only products.
The government needs to mind their own business! I understand what their reasoning is, but this is stepping their boundaries. We can't keep our children in a bubble for their entire life! Thankfully, I won't be effected too much. My children's clothes are about 1/2 hand-me-downs, but just from their older siblings, so it's not a big deal. That doesn't make up for the millions who will be effected though!
It turns out the new law will not affect items manufactured before Feb.10, nor affect resellers, etc. See cpsc /cpscpub/prerel/prhtm for the latest info.
