If someone dies theres always going to be a large investigation no matter the case So if theres proof that the brakes failed (which is easily prove able by technicians) then the district attorney may have some leniency toward the person who was driving the car however manslaughter is a crime in which accidental death occurs meaning yes, the person in the car committed manslaughter however he didnt, seeing how the breaks apparently went out However itll be up to the DA to decide whether he wants to press manslaughter charges on the person driving the car or not based off the break failure ruling and other evidence.
