Question:

Is it still possible to press charges on a domestic violence case?

I called the cops on my ex becuase we were involved in an argument and he hit me, I called the police in July 2009 and he was arrested and charged with assault/domestic violence at the time I did not press any charges, as of now the case is still open and he is on probation, can I still press charges if I want to?

Answer:

Someone pressed charges as he is on probation. Usually the police do under the law since most states do not require someone to press charges other than the police. If charged once, charging him again is unconstitutional. Moreover, this is probably a misdemeanor assault and the Statute of Limitations is 1 year. Too late.
Why would you want to do that?...Time has passed, get over it...Don't be rediculous about it. Unless he comes back at you and does somethign again than I you should press charges... As of right now, nearly TWO years after the incident you want to press charges on your EX?...lol..did one of your girlfriends put you up to this?...This is rediculous, grow up already.
