I just moved into a 1 BR apt. and realized there is no smoke detector. Does the landlord have to provide it?
and no one that owns one is going to give it away for free either.

I dont see why not? If you park on the same side of the street as a fire hydrant you have to have atleast 10 ft in distance from your car and the hydrant.
