Question:

Will our landlord replace our carpet?

Yesterday morning the toilet supply line to our toilet burst, and as a result we had crazy flooding. I would say close to half the carpet in our 2 bedroom apartment was drenched, with the neighbors downstairs getting a lot of the extra water.Anyways, they have removed a lot of the padding and set up fans under the carpet to dry it. Here almost two days later the carpet is close to dry, but this places reeks of that lovely mildew smell.....Everyone I have talked to said they should have just replaced the carpet. Do you think we can request they do it if the smell persists?

Answer:

There are no rules on the subject of while a landlord could replace a carpet. as long as a tenant will settle for the carpeting in place, the owner choose no longer replace it. in the experience that your animals urinated (somewhat the cat) on the carpets, those odors could be confusing to do away with. If the odors can not be eradicated, then the owner can use your cleansing expenditures, plus element of your protection deposit to swap the carpet. in many circumstances, a landlord can not fee the whole fee for carpet alternative, as he could depreciate' the fee of the carpet based upon its age and utilization.
No, it isn't their fault. If anything, it's your fault. They probably will replace it but you will have to play for it. While you are living in someone else's house, you are responsible for most of the stuff which goes wrong.
If the landlord had a professional service do the restoring you will be OK with relaying the carpet with new pad. It is normal for a professional Restoration Company to be able to fix a flooded carpet. They will dry the carpet using fans. then the carpet will be treated for mold. Then it will be cleaned and reinstalled. If you had your own home and your own insurance company, this is what an insurance company does. If the landlord just had a handy man do the repair, ask for a professional restoration co to do the cleaning and installing. It is unusual for a professional company not to be able to save the carpet with only a clean water flooded.
this is definitely the apartment complexes issue to fix. It wasn't your fault the apartment had a faulty line. The mildew smell. uld be toxic not to mention all the bacteria that was already in the carpet and was released into the air with the fans. They definitely should replace it. I suggest you check your states tenant law. Or tenants rights. You can google it by typing in your state and the words tenant rights. I am sure you will get all the information you need. Check your lease too, it may have stipulations.
