It's your brake pedal switch.
If both the tail lights and brake lights are the same bulb, one of the two elements is broke. If the tail lights are one bulb, and the brake lights are a separate bulb, the bulbs still could be bad, or the ground tab inside the socket may be corroded. Also check your brake switch under the dash...
I would check your break light switch. They can be bought at any NAPA, just need to know the type of car and they are not to expensive and pretty easy to put in yourself. I would start there.
Probably the brake switch mounted usually on the lower steering column where the arm of the brake pedal comes back to rest when you release it! It may have been moved out of it's holder or it may be worn out and needs replaced!
Depends on the c ar, but most cars, especially older cars use either a separate buld, or a separate set of filaments in a single bulb for the brake light, and tail light. It is quite common for the tail light to work, and brake light not to work.
