I ask you this. Did the contractor know when he built the home that the second floor was going to be used as a rental? If yes they should have wired a smoke detector in there for you on the existing smokes throughout the rest of the home. Reason is this. If this home is a basic home and does not have a fire rated wall between you and the downstairs then you could have a problem. It would not matter if this is just an attic but with some one living in a separate home like environment completely separate from your home this becomes just like an apartment as far as fire codes are concerned. But chances are it is just a single family dwelling and there fore the fire marshal may require this to be hard wired to your existing downstairs. The best bet here is to check your local fire codes to be sure before you rent and could avoid a hazard down the road. Different localities require different ways they do things so check to be sure. In my locality here because it is a single family dwelling and you have a separate living quarters with a sleeping area and probably a small kitchen as well with out a fire rated wall then they would have to be tied together to all one unit. The purpose of this is to protect you and the tenants if a fire should arise and the code states that outside the bedrooms (hallways or common area) and in the bedrooms on each floor as well as the basement all smoke detectors be tied together and have a battery backup as well as hard wired too. There are more codes but I will not bore you with them so ask to be safe.
Here the hard wired ones are illegal so the battery operated ones are the ones our fire code says to use. Each code has direction as to what can be used and where they should be installed. Whatever, be sure to use them. If you have one fire and they go off, you will never be without them again.
No, it is fine with a good battery in it at all times. Do change the battery when the time changes in Spring and Fall. This pretty much assures the battery is good.
I guess it depends on where you are and your local codes. The code that most municipalities are using now states that there must be a smoke detector inside each bedroom and one outside the bedroom in a common area, all hard wired together so that if one goes off they all go off. Therefore a battery alarm is insufficient.
