However, audio is based upon expected privacy of electronic communications (as in wiretapping) and video is based upon expected privacy of your appearance, which have very different social protections. You would have different expectations of privacy for your voice and for your appearance. However, in a rest room, locker room, and other places where you could be found naked, you may have a reasonable expectation of privacy for the appearance of those body parts not normally displayed in public. The legislature attempts to balance societal needs when drafting good laws. The owner of the locker room may have a right to protect his property from vandalism, but the customers may have a STRONGER need for privacy from being recorded on video tape for any reason.
