The energy absorbed by the rubber is eventually dissapated as heat through the intermolecular friction of the deformation of the material. Depending on setup the majority of energy would likely be returned to the system since rubber acts more like a spring (first order component) than a dashpot or second order component in a mechanical system.
No unfortunately once you sign on the proverbial dotted line, you are done. IF your lawyer explained to you that you could get more, but that this was available nowand then advised you to take the check. You are stuck with the result. And I might point out that even if your state's laws allow you to sue your attorney for advising you poorly. There is little realistic chance that you will get another lawyer to represent you, and even if you do the judge(who is a lawyer as well) will almost certainly find for the attorney that you are sueing. Reason: Attorney stick together in this little closed shop fleecing game know as law, and you are the odd man out.
