i was working at the time-went in to tell HR person that i was going to dr. as i couldn't move arm. she wrote it down as home injury because it was already hurting from working day before. Same injury happened year before and was a paid work comp. case.

Rules vary from state to state, but generally you can sue for anything. Doesn't mean you'll win.
