Could the transmission be bad?

my 1997 BMW 528i recently had a new transmission put in. my car was working fine for about a week, now the car occasionally wont shift into gear and the tachometer will go up to the number 4 or higher sometimes when im driving 30mph. what could be wrong? is it the transmission again?

Answer:

Either the transmission repair was lousy or something else just broke. (transmission repairs will only have warn parts replaced, everything else remains original) There could also not be enough transmission fluid or the transmission fluid is dirty.

It really sounds like the transmission. Take it back.
If it was put in right the fluid should be full. I would imagine they didnt align the transmission correctly when they replaced it if this is the case
