Were you fired or laid off? Have they denied you unemployment? Were any actual racist comments made? By all means call and speak with a labor attorney, but make sure you file for unemployment. From experience I know that you can remain angry and put all your energy into hatred and revenge while starving, or you can put it into a new job search. You may find that the next job is even better than you thought this one was. Everything happens for a reason and for every door that closes another one opens. I know it is hard to believe this now, but someday you just might find it to be true.
You are absolutely right. no kiddingand that really sux. in your second month of employment your conference call should have alerted you that something was wrong. That sort of conduct during a business meeting should not be allowed. by you, your boss, by the company in general. Well, you should file for unemployment anyway, and make them go through the hoops of proving your performance issues.. play the race card and go for it. or. you can recognize that the world is full of shxt and try not to be consumed by it. you are a professional and your reputation should not be based on one xyz-hole. First of all you need to have the hood repainted then have the hood insulation put in.
If your employer is an at-will employer then they can let you go with or without notice. Check your employee handbook or other documents they have given you about the company and see if that is mentioned. Another thing to consider is were you still in an introductory period with the company? Some companies will have people on probation (they call it introductory period) with the company anywhere from 90 days to 6 months. My second question to you is who said you were doing a good job? Was it your boss? The owner of the company? Can you sue, sure, you can try to do that. Your first step is to file a claim with the E.E.O.C. (Equal Employment Opportunity Commission) for wrongful termination. You will need to give them some information to support your claims, like the date and time of the conference call you mention and any other evidence you have regarding your allegations of racism. Were there other comments made about race that you heard? It will take the commission about 6 months or maybe a little bit longer to investigate the claim, both you and the employer have the right to appeal the decision two times. Then they will either dismiss your claim or give you a right to sue letter. You would take that letter to an attorney and then you can file a civil suit against the company. The whole process could take up to 2 years or longer before you will get to the deposition stage, which could go another 3 - 5 months. All told it could be about 3 - 4 years before you get to court (if it goes that far).
It all comes down to what state you live in. Where I live they have employment-at-will and that means that they have the right to fire you with no cause. You will be able to unemployment (it sounds like this wasn't your fault). Your local ESC will take down your side of the story and investigate it. I really don't think that you will be able to sue. If you would have mentioned the comment to the HR dept and it was documented, then you would have a better case.
