Question:

I hurt my arm at a shopping center chain that locked automatic doors?

I am disabled and use a wheelchair. I have an injured arm that I am careful about using. A grocery store I go to locks all automatic doors after 10 pm, forcing customers to pull open the exit doors which are heavy and have no handles on them. They open automatically OUT when done shopping but to get in they expect you to open them manually. Forced to do this, I re injured my shoulder. I know that locking automatic doors is a violation of ADA codes. What pain and suffering damages should I seek? Arm is in pain every day. It has disrupted my life.

Answer:

The store did no such violation. They have a right to close the doors at closing time and they always do this. In fact, in a mall, if you are not out on time, sometimes, you are forced to exit at the opposite end of the mall and then walk all the way around to your car. If you could not open the door yourself, you should have had the sense to go find help and ask for it. Your other option would be to pay closer attention to the time and be out before they close the automatic doors. You have no case. The store was not negligent and you would have to prove negligence in order to have a case. It is unfortunate that you hurt your arm but, you did it yourself by using poor judgment. The store had nothing to do with your decision to try and open a door with your injured arm, which you knew was already injured.
I guess the first question is why are you shopping at 10:00 PM when you know that the doors locked? You went into an exit door with no outside handles. Exit doors are not designed to be used as an entrance (But you know this right?) That is why they have no outside handles and say EXIT on them You seem familiar with the door policy as it looks like you shop at this store all the time because in your question you say A grocery store I go to So you know the policy and yet you went there anyway knowing the doors would be locked that enter the building and the only way in was through the exit doors The store locked these doors just before closing so people do not come in as they are open only for customers that have checked out and so they can leave, not for new customers coming in. The store was basically closed. As far as your pathetic lawsuit of trying to obtain money by using your handicap as an excuse, you have no claim, you went into a store that was closing, you stated yourself that there are no handles on the door which anybody with common sense would understand that these doors are not supposed to be entered through This law you seem to be harping on (AADA) only applies to doors that were meant to be used as entrances and the exit doors (Leaving) exit doors with no handles do not have to have automatic door openers and even if they did they can be shut off at closing time You have no lawsuit my using your disability for a grounds of a lawsuit when you did this yourself, nobody told you to enter that store through the exit doors did they? You waited until10:00 after these doors were closed (You admit that)
