how do you get power of atorney when the person who you need it for is in a vegetative state and cant sign anything? its for LNI check, he was hurt on the job, but his check has his name on it im his wife. what kind of poa would i have to look up im so confused
The short answer is that you can't. A power of attorney needs to be notarized, and the notary needs to see the person sign the document. Obviously, if he is in a vegetative state, he can't sign the document. If he is not capable of signing, then you won't be able to get a power of attorney. You can ask a court to appoint you as his guardian and/or conservator. The guardian and/or conservator has the right to endorse checks, etc. Contact an attorney in your area for more information on this process. For a referral, call your local or state bar association.
you don't need power of attorney. you're his wife, its given naturally. for the check, do you have a joint account? if you do just sign his name (even if he's dead) and sign yours under it - it's legal. if you don't have a joint account, go to the bank of the check (or a bank with your husbands account, along with his debit card/account info) and your marriage certificate and tell them he's in a vegitative state and you need to deposit the check/sign it. they'll let you (if they don't, talk to the manager. they have no reason to not allow you another thing, you can go directly to the person/company writing the checks and tell them to add your name on the checks. you're his wife, it should be no issue. my mom didn't have issues when my dad was in a coma. they had joint accounts though so that's probably why. but any check he got, she would just sign and deposit. no prob. bank was aware he was in a coma.
