Is using a cell phone while driving illegal where you are? It isn't everywhere (ie. Ontario, Canada) If it is: My guess is that he/she saw you using the phone and you thought you were very clever by stuffing it into the side pocket when the officer stopped you. People to similar things with seat belts. You see them not wearing it and when you pull them over it has miraculously appeared, and they innocently will swear on their dead grandmother's graves that they were wearing it the whole time.

If your state has a law for using a cell phone while operating a motor vehicle and the officer witnessed you using it while operating then yes it is a legal bust. If the officer makes an issue for having a cell phone in the vehicle then the officer should be reminded one of the basic safety principals of having a cell phone in a vehicle. I would recommend to any civilian to carry a cell phone in there vehicle at all times; you just never know when you may need to make that important phone call to save a life. These days finding an immediate communication device on the road is like seeing a celebrity getting ride on the side of the road; bad example I know
No. In the states where it is illegal to use a phone while driving, you actually have to be caught in the act. Just like in order to be charged with drunk driving, you can't just be walking towards your car with your keys out. You have to actually be in control of the vehicle like sitting behind the wheel with the keys in the ignition, or have the car running, or actually be driving.
