ok so we went to a Vegas casino buffet my nephew was put on the high chair after a few minutes it broke and he fell and hit his head. He cried for a little bit and we went home after dinner at night his mom noticed a big bump on his head so we took him to the ER. My question is can I sue the restaurant for hospital bills

no you are not a legal guardian. The mother CAN sue, but be aware that casinos have cameras EVERYWHERE and they keep all the footage in storage for years.
How can you show that it was not you or someone else in the group who broke the chair? You say they chair was broken and he fell out. That must be reasonable serious amount of damage to the chair. This leaves me asking. Why was this damage not discovered by the person who put him in the chair, as the responsible carer for the child, this person should have examined this chair as it was not a familiar item and so its condition was unknown. When this child started to move around in the chair where was its carer to who should have noticed there was a problem right away. This is a restaurant, how did no one not notice the problem and what was the parents doing when the child feel. Don't they monitor their children? How can she prove that the injury to the child that the hospital treated was the result of this broken chair. Honestly the parents should be charged with child abuse.
I would assume that you could sue, due to their equipment being faulty. I would personally ask a lawyer to find out your legal recourse, so they can give you a definite answer. Good luck.
Yes you can sue, everyone does it these days I am sure you know. Be advised though that (if by the small chance YOU were the one that purposefully broke the chair with the intention of suing because you gambled all your money away) they have surveillance cameras that will have you recorded.
Why would you sue? Couldn't the mom nicely explain what happened and simply ask them to pay the bills? Only if they refuse to pay what they legally owe can mom sue. The courts cannot be bothered with people who can't try to first get things settled without automatically suing each other and she could be ordered to mediation, which she should have done in the first place. Dear Casino Legal Dept: Enclosed are the hospital bills for the injuries to my son that occurred at 5:15 PM on April 2, 2011 in your buffet room.... [explain what happened].
