Question:

SOFA germany?

I am an American soldier living in Germany for about 7 years. I rent an apartment in Bad Bruckenau. In a wind storm, the stone tiles blew off the roof of my apartment and landed on my car that was parked next to my apartment. My landlord told me that the renter's liability insurance will not cover the damage. I have talked to the German police and several other people who all said that the landlord's insurance has to cover it. My landlord will not even give me the name of his insurance company. What are my rights in regard to the SOFA agreement? Where can I get a full copy of the SOFA agreement regarding housing laws?

Answer:

oh yea man, thats a tough break. The SOFA agreement says that if you have you're car parked next to your apartment and it has a sofa on it, then any damage incurred by the car while parked is the sole responsibility of the owner of said property, or in your case, the landlord. However, since you dont seem to have had a sofa an your car, looks like you're responsible. Mayb you can take some pictures of you car and photoshop a sofa on top of it, you might be able to sway the court with persuasive evidence
Check with JAG. They should have someone who is knows all about that stuff. Chances are, it's not the first time they've dealt with it.
The military's legal should have a copy of it. Why don't you sue the landlord. If the German law is on your side, then you should win the case. I am military also, but not sure about Germany's laws.
