Question:

can charges be pressed?

my ex had helped me get a phone under contract through her name. Now i told her that i would pay it as long as i had it and i made sure she could pay it if she had to take it back. so I was planning on keeping this phone for awhile and make payments on it. Well out of nowhere her parents want it back and my paycheck had to go to my new phone instead of paying off the one i had. I had made some charges on the phone that i could afford and now her parents want all this money from me to pay off the phone when i don't have it cause i quit my job for job corps. Can she press charges?

Answer:

She can take you to court.Without a written contract she probably will not prevail.
if u dont have the phone no u dont have to pay unless u missed payments while you had it
Not a criminal issue- this is a civil issue. It would likely go to small claims court. Sounds like a verbal contract to me...
If she has a written contract saying that you would pay the charges you made on it, then she can press charges and get all the money back now if she wants. If it was a verbal aggreement, then it is just he said she said and there is no hard evidence of such an aggreement. In that case, she can press charges, but she probably wont win, unless you get a crazy judge.
