The company may try to fire you (but all the more grounds for a lawsuit) I was hurt working one time and well I wanted to but money was tight and they just bought me off anyways... so they could try and fire you for trying to sue them, as far as being legal to do so, I don't think so.. Especially if your company is careless and hazardous, than you got an even bigger chance to win (I would think on legal grounds).. so if you want to pursue it hook up with a lawyer, build your case and than go slap em in the face with the supena to court.. You want it to be solid so it will go in your favor.. just remember that.. hope this helps..
Your question is somewhat redundant. If someone has been fired for this than I would assume they can be fired for it and I'm basing this answer based on the fact that they were fired. For the most part, if someone was fired it seems logical that they can be fired. Are you asking if they should be fired?
Legally. No. Unfortunately for him, most states are employment-at-will states. Neither employer nor employee are obligated to give notice or reason for terminating employment. Unless they told him that was the reason he was being fired and/or he has proof to back it up, he won't likely stand a chance at winning a wrongful termination suit against the company.
