can a real estate agent go into the listed property after a p.a. has been signed? she went in and took mail. yes, this is the " dual agent' i asked about before.

Is this a home you bought? After the home has closed, the agent has no right to go into the property without permission. I have gone back to remove the lockbox, but that does not involve going inside the property. I don't think she should have gone in to retrieve anything without permission, but to get laws in your state, contact your local Dept of Real Estate and ask if it is an infringement. If you are upset about it, file a police report. If you don't trust the agent to get mail, you must have a reason. So she is your agent? You have a contract with her? Dual situations are a bit sticky, you could have insisted that she referred out the buyers to another agent in her office so that this wouldn't have become an issue, but it's a little too late for that. I'm not sure it necessarily tresspassing since she is your agent, but if she did take mail addressed to you from you house, I believe that is against the law... mail tampering/theft is a federal offense. If you are not at all satisfied with how she is handling this transaction, here is what I suggest you do: Your listing is not with her, it is with her broker. Her broker is essentially the person/entity you have an obligation to. Call the broker directly and bring up your concerns. The broker can assign a new agent for you to deal with through the closing of your house... I would make it known that you are extremely unhappy with her entering your house without your knowledge searching for mail in your name. The broker's reputation is on the line... also the broker is liable legally and will jump to remedy the situation immediately. Don't hesitate to act on this... make the agent know that this is unacceptable and the broker will probably not allow her to take on the dual agency role in the future as its obvious she can't handle it (some agents can, but it is tough). I have a feeling she failed to disclose more then just the dual agency, it sounds like she may be related to the buyers. If there are any relationships (even distant, thru marriage, etc) it has to be disclosed. In a dual agency contract the agent still works on the SELLERS behalf. You are the one she has a contract to represent. The buyers should be an ace in the hole, and be IN YOUR ADVANTAGE. I read the comments you made after I was at your previous question. You wanted to know why I thought she put the buyers interest ahead of yours, it was this comment: she told her friend the buyer ( she told us this) that we could no longer afford the assoc fee on the condo we inherited after our mothers death, we were in a must sell situation. She had no business disclosing ANY of your personal facts, giving the buyer an edge over you, to the buyer. The furthest she could go and remain within the rules of dual representation would be, The buyers had a family tragedy and are open to offers. NOTHING about your personal financial situation should have been mentioned. On the mail. This is a federal offense. You need to file a complaint with the post office for your zip code, they handle this. Although they may not do anything they will give you a complaint number and documentation of the event. Include this in your complaint to your states real estate board. If I knew your state I would look it up for you! You really need to report this. The agent and her broker need to stop doing business. She obviously sees herself above the law. The problem is she is messing with very important issues to families, life savings and housing! She may not have seriously harmed you, but you do not know about the next family. Many many people have every dime they own tied up in a house. You can see that reading here! Good luck with this! First attempt to uncover any person you understand and believe. Whether they're a dealer, agent or legal professional. Just b/c they're this type of 3 does no longer routinely restrict them from being the correct individual for you. You have to think relaxed with them. Keep in brain throughout all of this, that they're running for you. If they don't seem to be running however simply amassing a paycheck, uncover any person else. Everyone of the aforementioned humans can and can make a big sum of money when you pick to paintings with them.
