Question:

Should schools be able to preform random drug tests?

The school I attend is thinking about performing random locker/ person check for drugs, weapons, etc. we live in a very safe area, and not to say that crime is immune to our community, but I think it’s kind of stupid. They also say they’ll automatically suspend any one caught with such items. Doesn’t that go against the law innocent until proven guilty? What if they aren't yours, what if you were bullied into hiding them? I think that’s not very fair, isn't this country suppose to be a democracy. I don't do drugs, but I’m against this. What do you think?

Answer:

School is private property of the government. Since it is private property, they can do whatever they want. If you dont like it, go to school somewhere else. I mean, I know that sounds harsh, but its the truth of the matter. Besides, with all the school violence, I want my childs school searched regularly for weapons. You may be sane and level and only carrying that pocket knife because your a guy and its the thing to do, but joe blow beside you may be crazy and gonna knife little susy. And as far as drugs are concerned, there are so many teens trying to pass off first things that arent drugs as drugs. That is dangerous because no one knows what they are really getting. Then, the rise of rx drug abuse creates a mentality with kids that all rxes are safe for anyone to take. That is soooo not true. So yeah, I want my childs school searched for drugs because I really dont want my child taking your parents heart medicine and ending up in the hosp when they thought they were just gonna get high and have fun. You have to step back and look at what these searches are trying to prevent, and where your rights end at protecting someone else's.
It sounds more like you have something to hide. . . . Say there are very few people who takes drugs in the school. . . . .what if they are smoking a joint in the toilet one day and your child walks in. . . . . .they offer them a smoke and your kids takes it. Likes it and does it regularly. . . . . . Do you really think a quick check of someones lockers or possessions is more demeaning than your kid taking drugs or getting stabbed in a fight. Come on be realistic. This can only be of benefit, and besides they wont be going around ripping peoples lockers open for no reason. It'll be on suspicion of. . . . . I dont understand why people object to change just because its a change. . . . it can only make things better unless you do drugs or carry weapons.
Yeah, for High Schools anyway. Schools already do that. I think they should because what if students WERE taking drugs? Drugs can easily kill you and make you into someone your not. They would need to stop it immediantly. So, I agree with the searches. I wouldn't care. As long as you don't take drugs, you'll be fine! In my High School, someone was hiding drugs in his car. The searches found it and were able to stop it. I'm not GLAD that they have searches, but they do help. They just do it for your own safety. Plus, it isn't a democracy for YOUR school. Once you join, you probably agreed to accept random searches. It's just to help and for safety. In America, people CANNOT randomly search you or your car unless you are suspected of something illegal. Then they get permission from a judge and then can search. But they can do it in high schools.
The school owns the lockers, and can check them any time they want. You would have the right to refuse a personal search, but I guarantee that the result of that would your being shown to the door, and a suspension. So, you do have a choice in the matter. It's not a good choice, but it is a choice. As for a drug screen, the courts have upheld (Earls v Tecumseh) that the school can administer suspicionless drug testing for students participating in extracurricular activities.. At this time, there's no legal precedent for a school to perform drug tests as a precondition for attending normal academic curriculum classes. This is based on the legal theory that since a students attendance to these classes is mandatory by law, the school cannot put up a barrier to attendance. That is, testing positive for prior use of a drug isn't good enough reason to keep you from attending classes, so drug testing of the overall student population would have little use.
well yes i think they should to keep their community safe...but only for things like if you are in extra-curricular activities!! and have to stay in mint condition you know? but i be pretty mad if they random drug tested me lol...i mean i dont do drugs either but just them thinkin ohhh she might be on somethin today...just makes me mad lol..but good luck with this
