Ask to get a copy of the inspection report Certificate of Occupancy (CO) the landlord is required to obtain before renting/leasing the premises. The landlord is required to maintain the habitability of the premises during the term of your occupancy. Specific requirements for the installation of the CO monitor will be determined by local ordinance; again, the local bldg. inspector will educate you on this. This is a matter of the implied warranty that the premises are suitable for the use intended. Without a working heating system adequate to maintain stated temps (for example: 70 degrees) between certain dates (for example: October 1 to April 30) in a location of a certain design temperature (for example: 15 degrees), the premises would be considered a sub-standard dwelling illegal for occupancy, particularly in exchange for rental monies.
