Your details are very fine but there is some information that you have not given. What restaurant is this? They would have to have proof that you stole something to show in court. Also, I think that you probably need to sue the restaurant because they have done character assassination. All of this would have to be hearsay. What evidence would they have? I can't believe that they are suing you. I think I would be looking at the managers.
