Question:

what if I dont press charges....?

my girlfriends ex-boyfriend rammed in to the side of my car with his car while me and my gf were in it, we called the cops and they came and took a report and later arrested him, now my gf and his mom are asking me not to press charges and that his mom wants to get him help (its a mess cause they have a kid together) what should I do? even if i don't press charges wont he still be tried and given a sentence? since he used his car as a weapon. how long will he get?

Answer:

Um... he showed no concern for you and your girlfriend's safety, why should he have the charges dropped? Who'd pay for the damages for your car?
What?! No! Press the charges. Of course his mom doesn't want you to, and your girlfriends doesn't want you to because he WAS her boyfriend at one point. I mean, if he hit you JUST right, he could of injured you or your girlfriend. He obviously doesn't care about neither of you to risk your safety like that. If you don't press charges, the whole thing will probably be dropped.
he has a right to confront any witnesses formed against him..that being said if you don't show up to say yes he did this or anyone else..his charges will more than likely be dismissed..it would be up to the state to prove beyond a reasonable he is guilty..meaning the prosecutor would need you to corroborate the events that took place..the prosecutor will try to threaten you with contempt if you don't appear..a scare tactic..you are a victim and its illegal to victimize a victim more than has already occurred..however you can speak to his lawyer not him directly..and let his lawyer know he needs some type of counseling and you would feel better knowing the court is monitoring..so if he is charged with a felony you would like that dropped to a misdemeanor and some counseling..to ensure his behavior changes...
You need to go through with the charges. It is through the grace of God that you are still here as your girlfriend's ex could have killed both of you. Tell the cops that you are being pressured into not going through with the charges. The police will set your girlfriend and his mom straight. By the way, the only effective help this jerk will get is if he is imprisoned and has to face the consequences of his behavior. If he is allowed to get away with it once again, he is apt to kill someone. As for how long he will get...that depends on his previous record (if any) and any mitigating circumstances. I wouldn't worry about it though. You are lucky to be alive and this guy's behavior is criminal. Jail is where he belongs. Good luck and God bless.
You didn't press charges or charge him. You filled out a Police Report. The Police investigated and charged him. Only the Police/DA can dismiss charges, and it isn't going to happen. What he did was very serious. The justice system will be the best help he can get. Mom obviously didn't do it. You did the right thing. Don't let anyone make you feel badly. PS If the Police work out a plea bargain or the gentleman pleads guilty , you and the girls will not have to sit in the courtroom.
