1. Yes, as long as it was only the console that was banned. Gamertag bans (or suspensions until Dec 31, 9999) are tied to the gamertag and then it won't work on any console. 2. If you've done something wrong, 1 report is enough. If you're clean, then it doesn't matter how many reports are made. All reports are looked at by actual people. 3. They do bans as well, but apparently the system is more automated. That's where some of the $$$ we spend on Gold goes -- to the people that enforce Xbox Live policy.
