Can someone press charges against you after you've already pressed charges on them?

I pressed charges on someone because they pulled a gun on me for no reason and then they turned around and tried to press charges on me for Verbal Assault in the 3rd degree...I was just wondering how that was possible or if it is?

Dude thats ****** up... Were you verbally assaulting them while they had the gun on you?!

Yes anyone can press counter charges (at least in NY), but the circumstances, situation and credibility go a long way in if those charges are ever followed through with by the police and the District Attorney. Just to add a case in point: in 1999 I was going through a divorce and my now ex brother in-law called and threatend to kill me, under the advice of my attoney I taped all phone calls at that time (Legal in NY). I had him arrested. Two days later he called the police and said that I called him from my house phone (he had it on caller ID) and said that I also threatened him, I was arrested fingerprinted and had mugshots taken. At the appointed court date I produced my home, and cell phone records proving I never called, he produced nothing. The charges were dropped against me. He was convicted of 1st Degree Aggravated Assault for using an electronic device to make a threat. He got 6mths in county jail and 2yrs probation. I got my Mugshots,Fingerprints, and Sweet Satisfaction all back.
