well court side with moms normally but when my parents divorced my dad got custody only casue my mom was looking for a job and place to live he agreed to give custody to her when she did but never ddi and that wemt o court and he got full custody i give you the best of luck cause i agree he isn;t mautre enough to have a kid
I'm in Florida too and went through the same thingContact Heart Of Florida Legal Aid SocietyIf you qualify, you'll get a lawyer free of chargeThey will prepare everything, talk to the judge, send out the letters, set the court dates, etcThe only thing I had to pay for was the court costs, which was $280But they put me on a payment plan of $5 a month so that's not a big dealWith him smoking pot, you can also request supervised visitation onlyThey can order a drug test to be done, and if he refuses, it counts as a positive resultJust make sure that you voice your concerns about him being alone with your sonAnd make sure you do it in an honest way to where it can't be interpreted as you just trying to make it where he can't see his son at allPart of that process also includes taking a parenting class, which you can do in person or onlineIt's about $35 if I remember correctlyState of Florida does NOT give sole custodyYou would instead get shared or joint custodyBut you would be awarded primary custody, meaning your son lives with you and his dad would get visitationSo it's really the same thing, but they wont use that wording b/c the state of Florida believes both parents need to be involved in a child's life equally(wouldn't it be nice if these deadbeat dads believed that too?)
