If so, what gets messed up and what's the optimal speed to go over them? If you can avoid going over it with half your car is it worth it or will that screw up balancing/alignment that much more?

It's true that anyone can file a lawsuit, but a good attorney won't lead you on if you don't have a chance to win. Find an attorney who specializes in labor law. If s/he agrees to take the lawsuit in exchange for a percent of the winnings (instead of asking for money up front), that's a good sign that you have a solid case.
