Question:

question about pressing charges?

Okay so i'm 15 years old and today i got beat up by my ex-boyfriend, broke my nose and he said he's going to kill me.I called the cops and i'm pressing chargesbut i was wondering do i get the money from the charges or like where does it go ?

Answer:

You are not pressing charges. In the USA criminal charges are pressed by the State, in the person of the DA, not by the victim. You reported the crime to the police - as you should of done - and they will pass the file to the DA who will press the actual charges. At this point, even if you changed your mind the DA would continue with the charges. If he is fined for the assault, that is a criminal penalty, and the money goes to the State. He may also be ordered by the court to pay restitution - if so, that will go to you. Those are the *criminal* issues. There is also a potential *civil* case. He injured you, causing you medical bills and pain and suffering. You can - and definitely SHOULD - sue him in civil court for compensation for that. As a minor, your parents will need to proceed with that. Edit... The law in Canada is exactly the same in this instance, except that it is the Crown, not the State, that presses charges. I know that cops often ask you Do you want to press charges?, but the legal reality is that what they really mean is Do you want charges to be pressed?. The final decision is NOT yours - it is the Crown Prosecutors. He can choose to prosecute even if you do not want him to, or choose not to prosecute even if you want him to. In domestic violence cases, the law often requires a prosecution even if the victim doesn't want one. Richard
There is no money from charges. You could sue him in small claims court but i am not recommending that. There will be a court hearing. You will get notification about the date. Don't miss it. I'm sorry this happened to you.
He did that to you and you think you will profit from it. No, you will get no money, but get as far away from him as you can, get protective orders and be there for court when they need you so he stays in as long as is possible. If you allow anything this guy will haunt you, harm you or worse.
For every criminal case that is filed (like what you have done), there is the potential of a private civil lawsuit that goes along with the criminal. What you now need to consider is hiring a civil trial attorney to sue your ex-boyfriend (and his parents if he is a minor) for assault. In the lawsuit, you demand money.
You don't have the ability to press charges. The officers can arrest, but the prosecutor's office will decide whether or not to file criminal charges for the battery against you. You can, however, tell the police that you would like for him to be prosecuted. No. You do not get money if criminal charges are filed. In some circumstances, he might be ordered to pay restitution as part of his sentence - but this is not guaranteed. Your parents would need to file a small claims action on your behalf against your ex and/or his parents to request civil damages.
