Are you sure this is what they are suing you about? Is it possible that others are saying you never split the tips? Or that money came up missing and they think it was you? Because I just can't see them filing a suit over this. They also filed an order to keep you out of the business so they really believe you stole something. It might not even be money. It could have been things or food. Hearsay is not admissable but they could call witnesses to testify and that IS. They can sue you for whatever the amount is they claim is missing. If they have evidence and can prove their case, I don't know what you would sue them for. Even if they don't prove it, what is your suit? As long as they had reason to believe you commited a crime, they are within their rights.
