Question:

I have power of attorney for my mentally ill son?

I have tried to open a savings account for my son while he is away, but the bank says they can't help if he is mentally ill when signing power of attorney. What to do?

Answer:

If a person is not mentally competent, he/she cannot legally execute a valid POA. You would need to establish a conservatorship. See an attorney.
do u mean he signed a power of attny when he was mentally unstable? then that POA is null and void.you need to apply for guardianship, Get an lawyer and have him apply for you.u need to be able to prove he is mentally ill, and do a yearly audit of his monies, and take classes on how to handle decisions.
