Well, if it is supposed to and it doesn't that's a serious problem. Not all places are actually covered by those regulations (unfortunately, IMO). I don't use non stick cookie sheets. My son bought me some regular cookie sheets from Williams Sonoma and I love them. They are not cheap, but they are lasting. If scratching is a problem, try using the rubber utensils instead of the metal ones. I have to use these on my non stick griddle. I don't like them, but it saves the pans from getting scratched. My son uses Silpats on his sheets. Once again, not cheap, but they will last as long as you don't take a knife to them.
